Elderly man killed after physical altercation with caregiver in Homestead – NBC 6 South Florida

An 80-year-old man died Sunday after an altercation between him and his caregiver at his home in Homestead, officials said.

According to an arrest report, around 9:21 a.m. Sunday, officers responded to reports of a battery with injuries at a home at 15001 Leisure Drive in Homestead.

When officers arrived, they met the suspect, 45-year-old Joan Ramos, outside the home and detained him pending investigation.

When police entered the home, they found the victim lying unconscious on his bedroom floor, an arrest report said. Shortly thereafter, Miami-Dade firefighters arrived and pronounced the man dead at the scene. Officers then contacted the MDPD Homicide Unit to begin an investigation.

Ramos spoke to police and, after being read his Miranda rights, said he was the victim’s caregiver and had lived in the home with his wife and the victim for about four years, the arrest report said.

Ramos told police that he heard a scream coming from the victim’s bedroom around 1 a.m. Sunday. He checked on the man’s well-being and said the victim appeared combative and grabbed Ramos by the neck, leaving a visible scratch. Ramos then grabbed the victim to restrain him, causing both of them to fall and hit a nightstand in the victim’s bedroom.

According to the arrest report, Ramos continued to fight with the naked victim and told police he did not want any contact with bodily fluids.

Ramos then said he hugged the victim from behind and used excessive force, causing both of them to fall forward.

The arrest report states Ramos fell on top of the victim and heard a crack as the victim’s head hit the ground face-first. He then told police that the victim was unresponsive after the fall.

It took approximately eight hours for Ramos to contact emergency services due to his state of shock and realization of his actions, the arrest report states.

However, he told police that he was aware that he had used excessive force against the victim and was never in fear for his life or safety.

Ramos is charged with aggravated involuntary manslaughter and a bail court judge set his bond at $15,000.

During Monday’s hearing, the judge said it shouldn’t be a “serious” manslaughter because Ramos didn’t mean to kill the man, but the state argued they focused on the “severe” part because of the victim’s age .
