The father of three is accused of having sexual intercourse in front of young girls

Mark Dolan’s case, 48, has been adjourned in Dublin District Court to prepare an evidence book.

Judge Treasa Kelly eased his bail conditions after the defense said Mr Dolan was under “a lot of stress” and was complying with strict conditions, including a curfew and daily registration at a Lake Garda train station.

Mr Dolan, formerly of Andrew Heights, Dún Brinn, Athy, Co Kildare, is accused of willfully masturbating in the presence of children on a date in Dublin last May.

The indictment alleges that this was for sexual gratification or “to corrupt or denigrate a child.”

The accused was arrested and charged in May.

When he reappeared in court to get the DPP’s instructions, Garda Sergeant Niall Murphy said they were in court to hear charges.

This means that Mr Dolan will be sent to Dublin Criminal Court for trial as soon as an evidence book is in place.

Asking the judge to change the terms of the bail, the defendant’s lawyer said Mr Dolan currently checks in at a north Dublin train station from 9am to 9pm every day and observes a curfew from 9pm to 6am.

He had a number of children and at one point he was at a hospital appointment and had to tell the gardai he might not be home by 9pm, she said.

He had been complying with the requirement to report daily for four months, and the attorney asked the judge to reduce it to weekly.

Instead, Judge Kelly eased registration to three times a week and said the curfew would now begin at a later time, at 11 p.m.

The judge adjourned the case to October, noting that Mr. Dolan took a day off for each court appearance and said he could be excused at the next appointment if the evidence book was not ready.

At his contested bail hearing in May, Gardai alleged that four girls were playing in a street when the defendant drove past them before parking his vehicle further down the street.

CCTV allegedly shows Mr Dolan getting out of his car and walking towards them across the road, a Garda said.

According to prosecutors, in the footage he unzips his pants and “keeps his hands on his genital area” as he walks towards the girls. You can see that “his hand moves a lot in his genital area,” Garda said.

As he walks back to his car, his penis is exposed and he appears to be smiling, sources said.

At the time, Judge Brendan O’Reilly ruled that Mr. Dolan could not be identified, but another judge, Cephas Power, later overturned that order following a media challenge.

Mr. Dolan has not yet commented on these charges.
